But can employers still place those employees on leave for being unvaccinated?&nbsp;Dinsmore Employment Practice Group Chair Faith Whittaker recently discussed the situation with <strong><a href=\"https:\/\/news.yahoo.com\/exemption-getting-covid-vaccine-employer-181451275.html\">Yahoo! News<\/a><\/strong>.&nbsp;Excerpts are below.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><em>For those who receive a religious exemption, that means indefinite unpaid leave. Employees with medical exemptions, meanwhile, will be placed on medical leave.&nbsp;The requirements have prompted questions about reasonable accommodations afforded to employees under federal law.<\/em><\/p>\n\n\n\n<p><em>\u201cThis can be very situational, very circumstantial, and depending not only on the employer and what industry they\u2019re in, but what the employee is actually doing as a job,\u201d said&nbsp;Whittaker.<\/em><\/p>\n\n\n\n<p><em>&#8230;<\/em><\/p>\n\n\n\n<p><em>According to Whittaker, companies have to consider what an employee who qualifies for an exemption does and \u201cwhether or not that accommodation \u2014 such as a leave \u2014 is going to work in that situation.\u201d Factors to consider might be whether the employee works directly with customers, how much of the workforce is already vaccinated and if remote work is possible.<\/em><\/p>\n\n\n\n<p><em>\u201cWhat is acceptable for a manufacturer worker is different for a flight attendant or professional employee of some sort,\u201d Whittaker said.<\/em><\/p>\n\n\n\n<p><em>&#8230;<\/em><\/p>\n\n\n\n<p><em>Given the fluctuating nature of the pandemic, Whittaker said she advises employers to communicate with their employees and be flexible as things continue to change.<\/em><\/p>\n\n\n\n<p><em>\u201cWe\u2019re telling our clients to be flexible in the sense of considering various exceptions and not pigeon-holing exactly what you will approve,\u201d she said. \u201cOnly because we just aren\u2019t aware of what\u2019s to come given how many things are new for us and for them.\u201d<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Read the full article <strong><a href=\"https:\/\/news.yahoo.com\/exemption-getting-covid-vaccine-employer-181451275.html\">here<\/a><\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Some people claim exemption from their employers&#8217; COVID-19 vaccine mandates either for medical or religious reasons.
